These Terms and Conditions (“Terms”) govern the use of Nexychat, a customer communication and CRM platform operated by Nexyverse. By accessing or using the Nexychat application, you agree to be bound by these Terms.
These Terms are issued in accordance with applicable Indian laws, including the Indian Contract Act, 1872 and the Information Technology Act, 2000.
Nexychat provides a platform that enables businesses to manage customer conversations on WhatsApp through a centralized inbox and CRM interface. The service supports user-initiated conversations and allows businesses to respond to messages in compliance with applicable platform policies.
Nexychat does not initiate unsolicited communications on behalf of users.
You must be legally capable of entering into a binding contract under Indian law to use Nexychat. By using the service, you represent that you have the authority to act on behalf of the business whose WhatsApp Business Account is connected to the platform.
By using Nexychat, you agree to:
Use the platform only for lawful business purposes
Ensure that all communications comply with applicable laws and Meta/WhatsApp policies
Obtain all necessary consents from end users before engaging in messaging
Not use the platform for spam, bulk messaging, or unsolicited communications
You are solely responsible for the content of messages sent through your connected WhatsApp Business Account.
Use of Nexychat is subject to our Privacy Policy, which explains how data is collected, processed, and protected. By using the service, you consent to data processing as described in the Privacy Policy.
Nexychat may offer AI-assisted features that provide suggested replies or message drafts. These features are intended to assist users and do not operate autonomously.
Final responsibility for reviewing, approving, and sending messages rests with the user. Nexychat is not responsible for the content or consequences of messages sent using AI-assisted suggestions.
You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. Nexychat shall not be liable for unauthorized access resulting from your failure to secure your account.
While we strive to maintain uninterrupted access, Nexychat does not guarantee continuous availability of the service. We may temporarily suspend access for maintenance, updates, or technical reasons without prior notice.
To the maximum extent permitted under Indian law, Nexychat and Nexyverse shall not be liable for any indirect, incidental, special, or consequential damages arising out of the use or inability to use the service.
Nexychat does not guarantee business outcomes, message delivery, or customer responses.
We reserve the right to suspend or terminate access to Nexychat if these Terms are violated, or if required to comply with legal or regulatory obligations.
Users may discontinue use of the service at any time.
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
We may update these Terms from time to time. Continued use of Nexychat after changes are published constitutes acceptance of the updated Terms.
